👇በፍ.ስ.ስህ.ቁ. 91. መሰረት አንድ ፍ/ቤት ውሳኔ ከመስጠቱ በፊት ማንኛውም ጊዜ ተከራካሪዎች ሲያመለክቱ ወይም በራሱ ጊዜ አቤቱታ እንዲሻሻል ሊያዝ ይችላል፡፡ ይህ ድንጋጌ በጠባቡ ሊተረጎም የሚገባው ነው፡፡ ለምሳሌ በአዲስ ማስረጃ ለማቅረብ ማሻሻልን ነሚጠቀሙ አሉ፡፡
👇በክስ ማሻሻል ስርዓቱና ዓላማ ቀድሞ ዳኝነት ከተጠየቀበት ጉዳይ ፈጽሞ የተለየ ጥያቄ ለማቅረብ የማይችል ስለመሆኑ አንቀጽ 91፣342 (መዝ.ቁ 100475(ቅጽ 19)
👇ለአንድ ክስ መሻሻል ወይም ለክርክሩ መለወጥ ቀደም ሲል የቀረብን የክስ ምክንያት በመቀየር ለመሞገት ማቅረብ ነገሩን ይበልጥ የሚያብራሩ ወይም ትክክለኛ ፍትህ ለመስጠት የሚረዳ ነው በሚል ክስ እንዲሻሻል የሚፈቅድበት የህግ ምክንያት ስላለመኖሩ የፍ/ስ/ስ/ቁ. 91(1፣2)
👇 በመጀመሪያ በቀረበ የክስ መከላከያ መልስ ያልተካተትን የመጀመሪያ ደረጃ መቃወሚያ መልስ አንዲሻሻል በሚል ፍ/ቤት በሰጠው ትእዛዝ መነሻነት ተካቶ ሲቀርብ ተቀባይነት ሊያገኝ የሚችልበት የህግ አግባብ የሌለ ስለመሆኑ አንቀጽ 91፣244፣ መዝ.ቁ. 55973(ቅጽ 12)
👇 ከሳሽ ያቀረበው ክስ እና የክሱ ዝርዝር ይዘት የተለያየ ሆኖ የተገኘ ከሆነ ፤ ጉዲዩ የቀረበለት ፍ/ቤት ክሱ ተሻሽሎ እንዲቀርብ በማዘዝ ፤የክርክሩን ሂደት መምራት ያለበት ሰለመሆኑ፤ ፍ/ሥ/ሥ/ህ/ቁ 91(1) (መዝ.ቁ 122249 (ቅጽ 20).

System for the Intervention of the Federal Government in the Regions.

Federal Intervention

The constitution strictly regulates the scheme of federal intervention by setting out substantive and procedural requirements. Three types of federal interventions;
First, when ‘security deterioration occurs’ in regional states and the latter demands the federal government to intervene in its affairs upon its own request (51(14))
Second, when ‘serious human rights violations arise’ and the HPR and the HOF jointly decides for intervention upon the initiation made by the HPR (55(16))
Third, when the ‘constitutional order is endangered’ and the HOF orders federal intervention (62(9))
Any federal intervention short of either of these grounds is unconstitutional and may generate conflicts between federal and regional governments.
