አካለ መጠን ባልደረሰ ልጅ ስም የተመዘገበ የማይንቀሳቀስ ንብረት በህፃኑ በሕጋዊ መንገድ የተፈራ ንብረት ስለመሆኑ ግምት ሊወሰድ ይገባል፡፡ ፍርድ ቤቶች ህፃኑ ንብረቱን ከራሱ የሃብት ምንጭ ወጪ አድርጎ ስለመግዛቱ አላስረዳም በሚል ምክንያት ንብረቱን ባልና ሚስት በጋብቻ ውስጥ ያፈሩት አንጂ የህፃኑ አይደለም በማለት ወስነዋል፡፡ ባልና ሚስቱ ንብረቱን በራሳቸው ፈቃድ ከጋራ ንብረታቸው ወጪ በማድረግ አካለ መጠን ባልደረሰ ልጅ ስም ገዝተዋል፡፡ አንዲህ ዓይነት ህፃናትን የሚመለከቱ ጉዳዮች የህፃናትን ደህንነትና ጥቅም በቀደምትነት መታሰብ ያለበት እና ለህፃኑ ጥቅም ተብሎ አንደተገዛ (እንደተፈራ) ንብረት ተደርጎ ሊወሰን የሚገባው ነው በማለት ምክር ቤቱ ውሳኔ ተሰጥቷል፡፡

የፌዴራል ጠቅላይ ፍርድ ቤት ሰበር ሰሚ ችሎት በሰ.መ.ቁ 211028 ጥር 27 ቀን 2014 ዓ.ም በዋለው ችሎት ከተጨማሪ እሴት ታክስ ደረሰኝ አለመስጠት ጋር በተገናኘ የአንድ ድርጅት ሥራ አስኪያጅ በወንጀል ተጠያቂ የሚሆነው እሱ የሚመራው ድርጅት የተጨማሪ እሴት ታክስ ተመዝጋቢ ሆኖ ያለተጨማሪ እሴት ታክስ ደረሰኝ ግብይት ማከናወኑ ሲረጋገጥ እንደሆነ: የድርጅቱ ሀላፊነት ከተረጋገጠ የስራ አስኪያጁ ሀላፊነት የሕግ ግምት የሚወሰድበት ስለመሆኑ: ሆኖም የድርጅቱ ስራ አስኪያጅ የድርጅቱን አስተዳደር በሚመለከት በውክልና ለሌላ ሰው ያስተላለፈ መሆኑ እና ተወካዩም በተቀበለው ውክልና መሠረት ሥራውን የሚያከናውን መሆኑ በተረጋገጠ ጊዜ ተጠያቂ የሚሆነው ውክልናውን ተቀብሎ ሥራውን በውክልና የሚያስተዳድረው ሰው እንጂ ስራ አስኪያጁ ወይም የድርጅቱ ባለቤት ሊሆን አይገባም በማለት ወስኗል።

የሰበር ችሎት በ ሰ/መ/ቁ. 213123 በሰጠው አስገዳጅ የህግ ትርጉም፡

በፍብ/ሥ/ሥ/ሕ/ቁ. 264 መሰረት ተከራካሪዎች ካቀረቧቸው ማስረጃዎች በተጨማሪ ለክርክሩ አወሳሰን ጠቃሚ የሆነ ማስረጃ ፍርድ ቤቱ የማስቀረብ ስልጣን እና ኃላፊነት እንዳለበት ያስገነዝባል፡፡ ሕጉ ኮመን ሎው (common law) እና ኮንቲኔንታል ሎው (continental law) የሕግ ሥርዓት የሚከተሉ ሀገሮችን አጣምሮ የያዘ እና ከኮመን ሎው የህግ ሥርዓት ከሚከተሉ ሀገሮች በተለየ ለዳኛው ጉዳዩንና ግራቀኙ የሚያቀርቡትን ማስረጃ ከማዳመጥ ያለፈ ተግባር እንደሰጠው ያሳያል፡፡ ድንጋጌው እውነትን የመፈለግ ዓላማ የሥነ-ሥርዓት ሕጉ እንዳለው የሚያሳይ እና ዓላማው እንዲሳካ የማድረግም ኃላፊነት የዳኛውም እንደሆነ ያስረዳል፡፡



በመዝገቡ ላይ ሰራተኛው ከመስሪያ ቤቱ የወሰደው ብድር ስለመከፈሉ ሰራተኛው የስራ ውሉ ሲቋረጥ የተሰጠውንና ዕዳ እንደሌለበት የሚገልጸውን ክሊራንስ አቅርቧል። በዚሁ መሰረት የስር ፍርድ ቤት ሰነዱን በማስረጃነት አጣቅሶ ከዕዳ ነጻ አድርጎታል።

በአሰሪው በኩል የቀረበው መከራከሪያ ክሊራንስ ቢሰጠውም ዕዳው ከደመወዙ ሲቀነስ አልነበረም የሚል ነው።

ችሎቱ ከላይ በሁለቱ የህግ ስርዓቶች የዳኛውን ሚና በንጽጽር ከለየ በኋላ በደረሰበት ድምዳሜ የስር ፍርድ ቤቶችን ውሳኔ ሲሽር በሐተታው ላይ እንዳሰፈረው፥



የሥር ፍርድ ቤቶች ዕዳው ስለመከፈል አለመከፈሉ የ1ኛ ተጠሪ የደመወዝ መቀበያ ፔሮል በማስቀረብ ጉዳዩ በተገቢው ማስረጃ ተረጋግጦ እንዲወሰን ማድረግ ሲገባቸው ይህን ሳያጣሩ ክሱን ውደቅ ማድረጋቸው በሕግ የተጣለባቸውን ክርክርን የመምራት ኃላፊነት ያልተወጡ ስለመሆኑ ስለሚያረጋግጥ ውሳኔው መሰረታዊ የሕግ ስህተት የተፈጸመበት ሆኖ አግኝተነዋል፡፡


ምን ትላላቹ?

በኔ በኩል ምንም እንኳን የኮንቲኔንታል ሎው (continental law) የህግ ስርዓት የዳኛው ሚና ከሙግት ታዛቢ ይልቅ መርማሪነቱ ቢጎላም ተከራካሪው በእጁ ያለውን ማስረጃ እንዲያቀርብ ትዕዛዝ ይሰጣል ማለት አይደለም። እንዲያ ካደረገ ሚናው ከዳኝነት ይልቅ ወደ አንደኛው ተከራካሪ ጠበቃነት ያዘነብላል። ( Abraham Y.)

Today, the Ethiopian parliament has approved a draft "Banking Business Proclamation," marking a major shift in the country’s financial landscape by allowing foreign banks to establish operations in Ethiopia.

የህዝብ ተወካዮች ምክር ቤት በኢትዮጵያ የውጭ ባንኮች እንዲሳተፉ የሚፈቅደውን የባንክ ስራ ረቂቅ አዋጅ ዛሬ አጽድቋል፡፡


- This legislation offers various avenues for foreign banks to enter the market, such as creating subsidiaries, opening branches, or acquiring shares in local banks. However, to protect local interests, strict regulations have been implemented, mandating that foreign ownership in local banks cannot exceed 49% of the subscribed shares, ensuring that 51% remains under Ethiopian control.

- Furthermore, the new law allows foreign banks to employ foreign nationals as senior executives but also emphasises the need for Ethiopian representation on the boards of these banks to maintain local oversight. The endorsement of this proclamation follows six months of deliberation after the Council of Ministers passed an initial draft.
